Terms, Conditions, and Acceptable Use Policy

 

AGREEMENT FOR USE OF COMPUTER CONTRAPTIONS INTERNET SERVICES

Computer Contraptions provides dialup access, Internet World Wide Web page hosting, newsgroup and e-mail services.

 

This is an agreement (“Agreement”) between Computer Contraptions (“Cctrap”), a California corporation, and the user (“User”) of Cctrap’s Internet access services and software (“Services”).  User agrees to abide by the terms and conditions of the Agreement in consideration for Services provided,  User must be at least 18 years old and must be legally able to enter into this Agreement before services can be provided.

 

If you do not agree with these terms, conditions, and policies please send mail to billing@cctrap.com , call or fax the Billing Dept. 516-5770 to terminate your account.  Usage of the account implies that you agree with these terms.

 

Agreement Terms

User agrees that Computer Contraptions may revise the terms and conditions of this Agreement, billing rates, account surcharges or services at any time.  Changes will be posted on Cctrap’s home page (www.cctrap.com), or by e-mail to User directly.

 

User agrees to review this Agreement from time to time to be aware of any changes.  User may terminate this Agreement at any time by providing Cctrap with a written notice by e-mail to

billing@cctrap.com

 

or by mail to Computer Contraptions, Inc. 8425 Brentwood Blvd., #A-2,  Brentwood, CA  94513.  Termination of this Agreement will be effective immediately upon receipt of User notification by an employee of Computer Contraptions or an authorized agent of Computer Contraptions.

Payment Obligations

User shall pay any registration or monthly fees, connect time charges incurred by User or its designated users at the rates in effect for the billing period in which those charges are incurred.  Each month (or other billing period selected) on the effective date of service agreement, User’s account shall be charged the monthly access and any other fees for the new month plus any accumulated charges for prior months.  Failure to use the User’s account does not relieve User of payment obligations.  Accounts exceeding the connect time included in their selected access plan will incur additional charges at the rate of $1.00 for each hour over the account limit.

 

Accounts are due and payable in full each month in advance of service date.  Accounts unpaid five (5) days after due date are considered delinquent and will be assessed a $10 late charge.  Accounts unpaid ten (10) days after the due date are canceled.  There is a $25.00 service charge for each returned check.  No exceptions.

 

Credit card authorized accounts will be debited automatically on the 1st or the 15th of each month, this is determined by the commencement of service date.  Your second month of service is pro-rated accordingly.

If for any reason the bank card services declines a payment request the users account will be charged a $10 special handling fee. 

Any account not brought current within the time frame stated in declined card notification is subject to cancellation.

 

A $25.00 restoral fee will be charged to re-activate any deliquent account.

Availability/Interruption

The Provider does not nor do any of their information providers, licensers, employees or agents warrant that the service will be uninterrupted or error free; nor does the Provider, licensers, employees or agents make any warranty as to the results obtained from the use of the Services.

 

Provider exercises no control over the content of the information passing through it.  Customer understands that the information that is available to it from Provider or over interconnecting networks, may not be valid or accurate.  Use of such information will be at Customer’s own risk.

 

The Service is distributed on an as-is basis without warranties of any kind, either expressed or implied including but not limited to warranties of title or implied warranties of merchantability or fitness for a particular purpose or use with respect to the service or information. Neither the Provider nor anyone else involved in creating , producing or delivering the Service shall be liable for any direct, indirect, incidental, special or consequential damages arising out of use of the Service or inability to use the Service or out of any breach of any warrant.  The provisions of this Clause will survive any termination of this Agreement.

 

Customer understands and agrees that temporary interruptions may occur as normal events in the provision of the Service.  Provider agrees to exercise reasonable care to prevent such occurrences and, if possible, will notify Customer in advance as to when such interruptions might take place.  Under no circumstances will Provider be held liable for any financial or other damages due to such interruptions.

 

Use Limitations

Customer agrees to comply with the rules and regulations applicable to any network that is accessed through Computer Contraptions.  Any attempt to break security or to access an account which does not belong to customer shall be considered a material breach of this contract, CCtrap may terminate this Agreement.  Upon such termination by CCtrap, Customer shall be liable for any applicable charges.

 

Lawful Purpose

Provider reserves the right to terminate the Service to the User in the event it is used in a manner which (a) constitutes violation of any law, regulation, or tariff: (b) is defamatory, fraudulent or deceptive; (c) is intended to threaten, harass or intimidate; (d) tends to damage the name or reputation of CCtrap; or (e) interferes with other customers’ use and enjoyment of the services provided by CCtrap.  What constitutes misuse or abuse of the Service is determined by CCtrap.

 

Cancellation

Customers can cancel their service any time.  Refunds will be given only for pre-paid amounts exceeding the current billing month. Any refunds due will be made by company check within fifteen (15) days of receipt of cancellation or credit card return.  If cancellation is caused by subscribers violation of any of these policies no refund will be given.

 

All account cancellations must be done in writing with a valid signature of the primary contact of the account, account name, and reason for cancellation to insure no further charges will be made to your account.
